1. General
The website elyashivlaw.co.il (the "Website") is operated by Adv. Or Elyashiv (the "Firm", "we"). This policy describes how the Firm collects and processes personal information of visitors to the Website and of those who contact the Firm through it, in accordance with the Privacy Protection Law, 5741-1981, and the regulations enacted under it (the "Law").
This policy focuses on information collected in the course of using the Website. Information provided to the Firm in the course of an inquiry for legal services or in the course of representation is subject, in addition to the provisions of the Privacy Protection Law, to the duties of privilege and professional confidentiality that apply to lawyers — duties that are in addition to what is stated in this policy and prevail over it to the extent that they grant broader protection.
Using the Website does not require you to provide personal information. Information is provided in the forms on the Website voluntarily and with your consent, and not under a legal obligation; however, without the requested details we will not be able to respond to your inquiry or provide the requested deliverable.
2. What Information Is Collected
Information you provide on your own initiative
- Forms and questionnaires on the Website — details you provide in the forms and questionnaires offered on the Website from time to time, including contact details (such as name, email address and phone number), the content of your inquiry and your answers to the questions presented in the form or questionnaire (for example, questions about the characteristics of your business).
- Consent to mailings — if you ticked your consent to receive content by email, a record of the consent and its date is also kept.
- Business engagement details — when you approve a personal offer sent to you: the business name and its identification number, the name and role of the person approving, email address, phone and country for the purpose of issuing the invoice, and a record of the electronic approval (time, IP address and the version of the terms approved).
Information collected as you browse
- Traffic data — the Website's server records, as is customary, technical data such as IP address, access times and browser type, for security and operational purposes.
- Local storage in the browser — the language preference you selected, and, while you fill in forms and questionnaires on the Website, temporary saving of your progress (which is deleted when the window is closed). This data is stored in your browser only and is not used for tracking. Additional storage in the browser, which takes place only subject to your consent to advertising cookies, is described in section 7.
- Cookies and pixels for measurement, statistics and advertising — subject to your consent only, as detailed in section 7 below.
3. Purposes of Use of the Information
- Responding to inquiries and providing the information or deliverable you requested (including deliverables and recommendations produced on the basis of your answers in the forms and questionnaires on the Website);
- Contacting you further to your request, including scheduling a call;
- Sending professional content, updates and offers by email — only if you have given separate and express consent to this;
- Marketing and tailored advertising — subject to your consent to the use of advertising cookies and pixels as detailed in section 7: displaying the Firm's advertisements to those who have visited the Website (Remarketing / Retargeting) on third-party websites and platforms; creating custom audiences and audiences with similar characteristics (Custom Audiences / Lookalike Audiences); and measuring the effectiveness of advertising campaigns — by means of the advertising tools of online advertising platforms (search engines and social networks);
- Operating, securing and improving the Website, including aggregate statistical analysis of its use;
- Complying with legal obligations and exercising or defending legal rights.
The information will not be used for other purposes without our obtaining your consent, unless this is permitted or required by law.
4. Mailings and Marketing Content
Professional content, updates and offers are sent by email only to those who have given their express consent, in accordance with the provisions of law that apply to direct mailing and to the sending of advertisements (including section 30A of the Communications Law (Telecommunications and Broadcasting), 5742-1982).
You may remove yourself from the mailing list at any time — using the removal link at the bottom of every message or by writing to office@elyashivlaw.co.il. The removal will take effect within a reasonable time and no later than the time set by law.
5. Disclosure of Information to Third Parties
The Firm does not trade in personal information and does not sell it to third parties. Information may be disclosed to the following parties, only to the extent necessary:
- Operational service providers — the Website's hosting provider and the Firm's email and calendar service providers, which process the information on behalf of the Firm and in accordance with its instructions;
- Payment processing and invoicing providers — when you pay the Firm online, the transaction details and the engagement details required for issuing an invoice are provided to the Firm's payment processing and invoicing provider. Your payment method details are provided by you directly to the payment processor, on its secure page, and are not stored by the Firm;
- Advertising platforms — subject to your consent to advertising cookies and pixels (section 7), browsing data from the Website is provided to online advertising platforms (search engines and social networks) for the advertising purposes described in section 3. To the extent that custom audiences based on contact details (such as email address) are used, the details will be provided to the platform in hashed form and for matching purposes only. These platforms also process the data in accordance with their own privacy policies;
- Competent authorities — where required by law, a court order or another lawful demand;
- In legal proceedings — to the extent necessary to exercise or defend the Firm's rights.
6. Transfer of Information Outside Israel
Some of the Firm's service providers (including the email and measurement service providers and the advertising platforms detailed in sections 3 and 7) store information on servers located outside Israel. These transfers are made in accordance with the Privacy Protection (Transfer of Data to Databases Abroad) Regulations, 5761-2001, including to providers that have undertaken toward the Firm to ensure an adequate level of protection for the information.
7. Cookies and Measurement
The Website uses three types of means:
- Essential means — local storage in the browser to save the language preference and to operate the forms and questionnaires on the Website, as described in section 2. These means are required for the Website to function and are not used for tracking.
- Measurement and statistics cookies — loaded only after you have approved this in the consent window displayed on the Website. They are used to produce aggregate statistics on the use of the Website (pages viewed, visit duration and the like) in order to improve it. The information is processed on behalf of the Firm by Google Analytics. An explanation of how Google uses information from sites that use its services is available at policies.google.com/technologies/partner-sites. In accordance with the data sharing settings selected by the Firm, Google may derive aggregate, non-identifying information from the data and use it for its own purposes as well, and its representatives may review the Website's usage data in order to provide recommendations to the Firm.
- Advertising cookies and pixels — loaded only after you have approved this in the consent window. Third-party advertising providers (online advertising platforms) use cookies and pixels to display the Firm's advertisements on other websites and apps based on your previous visits to the Website (Remarketing), to create custom audiences and audiences with similar characteristics (Lookalike) and to measure advertising performance. The data is also processed by these platforms in accordance with their own privacy policies. In this context, the identifier of the advertising campaign through which you reached the Website is also stored in your browser, for up to 90 days, and it is attached to your inquiry if you submit a form or questionnaire, for the purpose of measuring advertising performance.
Your choice is saved in the browser. You may change your preferences or withdraw your consent at any time via Manage cookie preferences, and also by deleting the Website's data, or by blocking or deleting cookies in your browser settings — without this affecting your ability to use the Website.
To document the existence of consent, whenever consent is given, changed or withdrawn, a record is kept in an internal log of the Firm that includes a random identifier assigned to your browser, the time of the action, the categories approved or switched off and the version of this document that was shown to you. The record does not include an IP address or any other identifying detail, and is not used to track you or for any purpose other than proving the existence of consent and its date.
In addition, you may opt out of ad personalization (Opt-Out) in the advertising settings of your account with the advertising platforms you use, and also through the centralized opt-out tools at aboutads.info and youronlinechoices.eu.
8. Information Security
The Firm implements organizational and technological security measures in accordance with the Privacy Protection Regulations (Data Security), 5777-2017, including encrypted traffic (TLS), restricting access to the information to authorized persons only and securing the systems in which it is stored. However, we cannot guarantee absolute immunity against unauthorized access, and we do not undertake that the Website will be absolutely immune to security risks.
9. Information Retention Period
The information is retained for as long as it is required for the purposes for which it was collected, including documenting engagements and responding to inquiries, or for as long as there is a legal obligation or justification to retain it. At the end of that period, the information will be deleted or rendered non-identifiable. You may request the deletion of the information collected about you at any time, as detailed in section 10.
10. Your Rights
Under the Law, you have, among others, the following rights:
- Right of access — to inspect the information held about you in the Firm's databases;
- Right to correction and deletion — to request the correction of information that is not correct, complete or up to date, or its deletion;
- Removal from mailings — to demand the deletion of your details from the mailing list, as detailed in section 4.
To exercise your rights, you may write to office@elyashivlaw.co.il. If you believe that your right under the Law has been infringed, you also have the option of contacting the Privacy Protection Authority.
11. Minors
The Website and its services are intended for business owners and professionals, and are not directed at minors. We do not knowingly collect information about minors under the age of 18.
12. Changes to the Policy
The Firm may update this policy from time to time. The updated version will be published on this page, and the date of the last update will be stated at its top. A material change in the way information that has been provided is used will apply only subject to the provisions of law.
This Privacy Policy is a translation of the Hebrew Privacy Policy. If there is any inconsistency between the English and Hebrew versions, the Hebrew version prevails.
